DMCA Policy for Lots-o'-Huggin' Bear

Lots-o'-Huggin' Bear ("Lotso", "we", "us", or "our") is deeply committed to fostering an environment of respect for intellectual property rights. Just as we cherish our own fluffy existence, we uphold the principles of the Digital Millennium Copyright Act (DMCA) and expect our users to do the same. This policy outlines the procedures for reporting alleged copyright infringement on our platforms and for submitting counter-notifications if you believe your content was mistakenly removed.

It is our firm policy to respond promptly to clear and valid notices of alleged copyright infringement that comply with the DMCA. Upon receiving such a notice, we may remove or disable access to the infringing material. Furthermore, we reserve the right to terminate accounts of repeat infringers in appropriate, albeit sometimes sticky, circumstances.

Filing a DMCA Notice of Infringement

If you believe that your copyrighted work has been copied and made accessible on our service in a way that constitutes copyright infringement, you may submit a DMCA notice to our designated Copyright Agent. To ensure your notice is effective, it must be a written communication that includes substantially the following information:

  1. Identification of the copyrighted work claimed to have been infringed: Provide a precise description of the copyrighted work you claim has been infringed. This should include its title, author, and any registration numbers if applicable.
  2. Identification of the material that is claimed to be infringing: Clearly describe the material you believe is infringing your copyright. Crucially, provide sufficient information for us to locate this material on our site (e.g., the exact URL(s) of the specific page(s) where the material is found).
  3. Information reasonably sufficient to permit us to contact you: Include your full legal name, physical address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please send your complete DMCA notice to our designated Copyright Agent. You can find their contact information on our Contact Us page. We strongly recommend consulting with a legal professional before filing a notice of infringement.

Filing a DMCA Counter-Notification

If you believe that material you posted has been removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our designated Copyright Agent. To be effective, your counter-notification must be a written communication that includes substantially the following:

  • Identification of the material that has been removed or to which access has been disabled: Provide the URL(s) of the material as it appeared on our site before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Lots-o'-Huggin' Bear may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature.
